Terms of Service
Our business model: TickCare (Hong Kong) Limited is a Hong Kong-based product sourcing and procurement business. We accept retail and wholesale orders, procure products through Hong Kong sourcing arrangements and organise international dispatch to customers in eligible destinations. The recipient is ordinarily responsible for destination-side import formalities and charges, subject to applicable law.
1. About TickCare and these Terms
1.1. The website www.tickcare852.com (the “Website”) is operated by TickCare (Hong Kong) Limited (“TickCare”, “we”, “us” or “our”), a Hong Kong company. These Terms of Service (“Terms”) govern use of the Website and orders placed with TickCare.
1.2. TickCare is a Hong Kong-based product sourcing and procurement business. We help customers purchase products available through our Hong Kong sourcing channels and arrange shipment from Hong Kong or another agreed dispatch point to the customer’s nominated destination. Please read Section 2 for how this service works.
1.3. We welcome individual retail customers and trade or wholesale customers. “Consumer” means an individual acting mainly outside their trade or profession; “Business Customer” means someone ordering mainly for business purposes.
1.4. By placing an order, you acknowledge these Terms and our Privacy Policy. Where a specific product, quotation or wholesale agreement contains expressly agreed terms, those terms apply to that transaction to the extent they are consistent with applicable law. Mandatory legal rights are not excluded by these Terms.
2. Our Hong Kong Procurement and International Delivery Model
2.1. TickCare accepts and manages orders as a Hong Kong-based business. Following our acceptance of an order and verification of payment, we procure the requested goods through our Hong Kong sourcing arrangements, prepare the order and arrange international dispatch to the destination nominated by the customer.
2.2. TickCare is the contracting party for goods and any agreed procurement or fulfilment services unless we expressly identify another contracting party in writing. The sourcing and order-administration arrangements are operated from Hong Kong. The customer instructs us to arrange dispatch to the delivery address they designate.
2.3. We welcome enquiries and orders from retail and wholesale customers worldwide. However, acceptance of an order and its dispatch depend on product availability, carrier coverage, trade restrictions and the legal requirements applicable to the goods and shipment. The customer must check the destination country’s import, possession and resale requirements before ordering, as detailed in Section 8.
2.4. A Hong Kong procurement or sales arrangement does not automatically displace mandatory laws applying to a transaction, consumer or shipment. The parties’ responsibilities under these Terms apply only to the extent permitted by applicable law, including any non-excludable consumer and product-safety obligations.
3. Eligibility and Customer Information
3.1. You must have legal capacity to make the purchase. If you place an order for a company or another person, you confirm that you are authorised to do so.
3.2. You must give accurate contact, delivery and payment-reference information and promptly notify us of material changes. We may reasonably request further details where necessary to process payment, assess destination restrictions, satisfy shipping requirements or prevent fraud.
3.3. You must not place an order for an unlawful purpose or request a shipment that would breach applicable sanctions, trade, product or customs rules.
4. Products, Descriptions and Availability
4.1. Product photographs, descriptions, packaging, country-of-origin details, ingredients, quantities and prices are provided to help customers assess the goods. We aim for reasonable accuracy, but suppliers may change packaging or specifications. Please check the current product listing and contact us before ordering if a particular ingredient, size, packaging version or expiry date is important to you.
4.2. Availability shown on the Website is subject to confirmation. Because some products are sourced following an order, we may be unable to obtain an item. We will inform you and offer an agreed alternative or cancel the affected item with an appropriate refund. We will not substitute materially different goods without your consent.
4.3. Obvious website or pricing mistakes may be corrected. If an error affects an order we have not accepted, we may invite you to accept the corrected terms or decline the order. For an accepted order, we will not impose a higher price without your agreement; where the order cannot proceed, we will provide any refund due.
5. Ordering and Contract Formation
5.1. An order submitted through the Website is a request to purchase. An automated message acknowledging that we have received the request does not necessarily mean it has been accepted.
5.2. We will confirm acceptance by an order-acceptance message, payment verification and/or an express confirmation that procurement or fulfilment has begun. The applicable contract is made with TickCare when we communicate acceptance. Orders are managed through our Hong Kong business.
5.3. Before acceptance, we may decline an order for reasonable reasons, including stock shortages, payment issues, destination or carrier restrictions, suspected misuse, or legal compliance. If we decline an order after receiving payment, we will return the relevant amount in accordance with Section 11.
5.4. Contact us promptly if you wish to change or cancel an order. We will confirm what can be changed before procurement or dispatch. Once procurement or dispatch has begun, changes may not be possible; this does not affect any cancellation or refund rights you have under applicable law.
6. Prices, Currency and Accepted Payments
6.1. Unless clearly stated otherwise, the Website displays product prices in British Pounds Sterling (GBP). Shipping charges and any taxes or fees collected by TickCare will be shown or communicated before the customer is bound to pay, where required by law.
6.2. TickCare currently accepts only the following payment methods:
-
UK bank transfer in GBP to the bank details designated by TickCare; and
-
Hong Kong Faster Payment System (FPS / 轉數快), normally in Hong Kong dollars (HKD), using payment details supplied by TickCare.
6.3. For an HKD payment, we will communicate the HKD amount and applicable conversion basis or agreed exchange rate before payment. Website prices do not imply a permanently fixed GBP/HKD exchange rate.
6.4. Payment instructions are provided during or after the order process as appropriate. You should check the recipient details and include any requested order reference. Do not transfer funds to bank or FPS details received from an unverified third party.
6.5. We begin procurement and fulfilment after receiving and verifying the required payment, unless we expressly agree otherwise. TickCare does not currently accept credit cards, debit cards, PayPal, Shopify Payments, cash on delivery or cheques through the Website.
6.6. Banks and transfer providers may charge their own fees. We will disclose charges imposed by TickCare before payment; any other bank or currency-conversion charges are subject to the relevant provider’s terms. Nothing in this section limits tax obligations imposed on TickCare by applicable law.
7. Shipping, Estimated Delivery and Delivery Problems
7.1. We arrange international shipping to eligible destinations using postal or courier services. The available service, shipping charges and estimated timing may vary by product, destination, stock availability and carrier conditions.
7.2. Published shipping estimates are estimates, not guaranteed delivery dates, unless we expressly agree a guaranteed date. Any stated estimate should be read together with the expected procurement and dispatch time. We will communicate significant delays where reasonably practicable.
7.3. The customer is responsible for providing accurate and complete consignee details, delivery address and any reasonable customs information, and for arranging timely acceptance of the parcel. Reasonable, demonstrable additional costs resulting from incorrect details, failure to respond to customs enquiries or refusal of delivery may be charged to the customer to the extent permitted by law and where they were properly disclosed.
7.4. If a package is lost, arrives damaged, contains an incorrect product or is materially delayed, please contact tickcare852@gmail.com with your order number and relevant evidence. We will investigate with the carrier and provide any remedy required under applicable law or these Terms.
7.5. Responsibility for goods in transit and the passing of risk are determined by the applicable contract and any mandatory law. We do not treat delivery to a courier as automatically transferring all risk to a consumer where the law provides otherwise.
8. Destination Importation, Customs and Recipient Responsibilities
8.1. Unless expressly agreed otherwise and subject to applicable law, the customer or named recipient is responsible for acting as the importer of record at the destination where this is legally permitted and for complying with the destination country’s requirements for importation, customs clearance, possession, use and, if applicable, onward resale. The customer must ascertain those requirements before ordering.
8.2. The customer or recipient is ordinarily responsible for obtaining any destination-side import approval, permit, prescription, registration or other document legally required of them; making any declarations lawfully required of the importer; and promptly providing accurate information requested by customs authorities, postal or courier services. TickCare may decline or cancel an order if the legal requirements for the shipment cannot be met.
8.3. Unless the agreed price expressly includes them or applicable law places the relevant collection or payment obligation on TickCare, destination import VAT, customs duties, tariffs, brokerage charges, customs handling fees, inspection charges, storage charges and similar import-related costs are payable by the customer or recipient. We recommend that customers verify the likely charges in advance; these charges may be assessed by authorities or carriers after dispatch.
8.4. If customs or a carrier stops, detains, refuses, returns, seizes, destroys or disposes of a parcel because the customer or recipient failed to satisfy a destination-side legal requirement, supply required information, pay a charge or accept delivery, the customer may be responsible for the resulting lawful and reasonably incurred costs, and for losses directly caused by that failure, to the extent permitted by applicable law. We will assess the actual cause and any mandatory refund or other remedy before determining the outcome; there is no automatic forfeiture of statutory rights.
8.5. The customer must not request false customs descriptions, artificially reduced valuations, misleading declarations or shipment methods that would breach applicable law. The parties will cooperate in providing accurate shipment and customs information. TickCare will perform any customs or carrier declarations that are legally required of it accurately and will not be required to follow unlawful instructions.
8.6. Responsibilities imposed by Hong Kong law on TickCare as a trader, supplier, consignor or exporter—including any required export licences or restrictions—remain TickCare’s responsibility. Responsibilities imposed by destination law on the customer as importer, consignee, user or reseller remain that customer’s responsibility. Nothing in these Terms can transfer a duty imposed by law on one party to the other without legal effect.
9. Our 30-Day Voluntary Returns Policy
9.1. In addition to any rights you have under applicable law, TickCare offers a voluntary 30-day returns policy for eligible products. To request a return, email tickcare852@gmail.com within 30 calendar days after you, or someone you nominate, receives the product.
9.2. For a change-of-mind return under this voluntary policy, the item must ordinarily be unused, unopened, in its original saleable condition, and returned with its original packaging and any tamper-evident seals intact. Proof of purchase is required.
9.3. For health, safety and hygiene reasons, we may be unable to accept a voluntary change-of-mind return of a medicine, healthcare item, cosmetic, infant-care item or other hygiene-sensitive product after its protective seal is broken, or where the item cannot be safely resold. Perishable goods, personalised items, and goods that cannot legally be sent back may also be ineligible for a voluntary return. These exclusions do not limit rights for faulty, damaged or misdescribed products.
9.4. Contact us before sending goods back so we can provide the appropriate return destination and instructions. Unless a different period is required by law or agreed in writing, send the return within 14 calendar days of our return instructions. Do not send goods to an unconfirmed address.
9.5. For a voluntary change-of-mind return, the customer normally bears return postage and any lawful return-import charges. The original outward delivery charge is ordinarily not refunded under this additional voluntary policy, except where applicable law requires otherwise. We recommend a tracked shipping service and suitable protective packaging.
9.6. Returns for defective, damaged, incorrect or materially misdescribed goods are dealt with under Section 10 and any applicable legal rights, and may have different conditions and cost allocation. Wholesale or special procurement arrangements may have separately agreed returns terms, without limiting mandatory rights.
10. Statutory Cancellation Rights and Problems with Goods
10.1. The 30-day voluntary returns policy is additional to, and does not replace or reduce, mandatory consumer cancellation, refund, repair or replacement rights that apply to a particular order.
10.2. In jurisdictions where a consumer has a statutory distance-selling cancellation period, that right and its statutory procedure take precedence. For example, where the United Kingdom Consumer Contracts Regulations apply, consumers generally have 14 days after delivery to notify cancellation and a further 14 days to return goods, subject to statutory exceptions such as certain unsealed goods supplied for health protection or hygiene reasons.
10.3. If a product is faulty, arrives damaged, is incorrect or materially differs from its description, contact us as soon as reasonably possible and provide your order number and relevant photos or other information. We will assess the issue and offer an appropriate repair, replacement, price reduction, refund or other remedy to the extent required by applicable law.
10.4. An exemption from change-of-mind returns does not remove rights relating to faulty or misdescribed goods. We will not require a customer to accept store credit instead of a money refund where a cash-equivalent refund is legally due.
11. Refunds
11.1. Once a return or cancellation is approved, we will confirm the amount, currency and method of refund. Refunds are normally made by bank transfer or FPS, depending on the original payment arrangements and practical availability. We may reasonably verify the payee before transferring funds.
11.2. Refunds under the voluntary 30-day policy ordinarily cover the returned product’s purchase price, less any deductions permitted and disclosed under that policy. Statutory refunds will include any shipping charges or other amounts required by applicable law.
11.3. Where applicable law imposes a refund deadline, we will comply with it. For other approved voluntary returns, we aim to issue the refund promptly after receiving and inspecting the returned goods. We will explain any reasonable delay.
11.4. For payments originally made in HKD, we will ordinarily refund in HKD; for payments originally made in GBP, we will ordinarily refund in GBP, unless another arrangement is agreed or required by law. Exchange-rate movements or charges imposed by banks may affect amounts received following a conversion; we will not use exchange-rate changes to avoid a refund otherwise due.
11.5. Store credit may be offered only as an option where permitted by law and accepted by the customer. It is not the only form of refund available.
12. Retail and Wholesale Purchases
12.1. Retail customers may purchase products for personal use. Business customers are welcome to request wholesale quantities, sourcing assistance and commercial quotations.
12.2. Wholesale prices, minimum quantities, procurement lead times, deposits, return conditions and other business terms may be agreed separately in writing. Such terms will not automatically apply to an ordinary retail order.
12.3. Business customers intending to resell, distribute or supply the goods must satisfy the laws applicable to their own commercial activities, including any local product registrations, labelling, marketing, consumer safety, import and tax obligations. They must not represent that TickCare has approved or authorised their downstream sales. TickCare remains responsible for duties imposed upon it by applicable law.
13. Medicines, Healthcare and Product Information
13.1. TickCare may offer medicines, healthcare products, personal care products, cosmetics and other consumer goods. Not every product is suitable or authorised for sale, export, import or use in every country.
13.2. Product information on the Website is general information and is not individual medical, pharmaceutical or other professional advice. Read the product packaging, dosage instructions, warnings, ingredient list and expiry details before use. Seek advice from a qualified professional when appropriate.
13.3. Customers must check the legal requirements of the destination for importing, possessing and using medicines and other regulated goods, and any conditions applying to onward resale. TickCare may refuse or cancel an order that cannot lawfully be sourced, supplied, exported or dispatched. Nothing in these Terms waives legal duties that apply to TickCare itself.
14. Customer Accounts and Acceptable Use
14.1. Customer accounts and order records may be provided using features available through Wix. You are responsible for keeping your login credentials confidential and informing us of suspected unauthorised use.
14.2. You must not misuse the Website, interfere with its operation, attempt unauthorised access, distribute malicious code, impersonate others, or use the Website for fraudulent or unlawful purposes.
14.3. We may suspend access where reasonably necessary for security, fraud prevention, breach of these Terms or compliance with law. Suspension does not remove any order-related or statutory rights that already exist.
15. Intellectual Property and Reviews
15.1. The Website’s original text, layout, design and other TickCare-owned content are protected by applicable intellectual property laws. Third-party brands and product marks belong to their respective owners. You must not reproduce our content for commercial use without permission, except where the law permits.
15.2. If we enable product reviews or customer submissions, you must submit lawful, accurate content and respect the rights of others. By posting content, you grant TickCare a non-exclusive, worldwide, royalty-free licence to display and use that content for operating and promoting the Website, to the extent permitted by law; you retain ownership of your content.
15.3. We may remove unlawful, misleading, offensive or infringing submissions and may respond to substantiated intellectual property complaints sent to our contact email.
16. Privacy, Communications and Third Parties
16.1. Our collection and use of personal information are explained in the Privacy Policy at https://www.tickcare852.com/privacy-policy. Questions or requests may be sent to tickcare852@gmail.com.
16.2. We may communicate about orders, payment verification, shipment updates, service matters and changes to these Terms by email or other channels you have agreed to use. Marketing communications are governed by your choices and applicable law.
16.3. Third-party websites, banks and logistics operators may be subject to their own terms and privacy notices. We are not responsible for independent third-party content, but we remain responsible for our own obligations under law and these Terms.
17. Availability, Events Outside Reasonable Control and Liability
17.1. We aim to maintain the Website and provide services with reasonable care. Temporary interruption, supplier shortages, carrier disruption, customs action or events outside reasonable control may affect fulfilment. We will communicate material impacts and work towards a reasonable solution.
17.2. Nothing in these Terms excludes or restricts liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, a seller’s own unlawful conduct or breach of non-excludable duties, or any other liability or consumer remedy that cannot lawfully be excluded or restricted.
17.3. Subject to Section 17.2, neither party is responsible for losses that are not reasonably foreseeable at the time of contract or that arise from the other party’s breach or misuse. Where a business-to-business contract contains separately negotiated limitations, those provisions apply only to the extent permitted by law.
18. Restricted Destinations and Sanctions
18.1. We may decline, hold or cancel orders, with any refund due, if performance would breach applicable trade sanctions, export controls, destination import restrictions, carrier restrictions or other legal requirements. The customer is responsible for providing accurate information about the recipient and destination and ensuring that destination-side permissions that apply to them are obtained.
18.2. Customers must not provide false declarations, seek prohibited transactions, or direct us to a restricted recipient or destination where doing so would violate applicable law.
19. Governing Law and Dispute Resolution
19.1. These Terms and the contractual relationship with TickCare are intended to be governed by the laws of Hong Kong, subject to any mandatory legal rights and rules that apply to the customer or transaction notwithstanding this choice of law.
19.2. Please contact us first at tickcare852@gmail.com so we can investigate and attempt to resolve any problem. If a dispute cannot be resolved, the courts of Hong Kong may have jurisdiction, but nothing in this clause prevents a consumer from using courts or remedies that cannot legally be excluded in the consumer’s jurisdiction.
19.3. We do not impose mandatory confidential arbitration on retail consumers through these standard Terms.
20. Changes, Severability and General Terms
20.1. We may revise these Terms to reflect changes in our services, payment methods or legal requirements. The current version will be made available on the Website. Changes will not retrospectively reduce rights under orders already accepted unless permitted by law and validly agreed by the parties.
20.2. If any provision is found unenforceable, the remaining provisions continue to operate to the extent legally possible. A delay in enforcing a right does not automatically waive that right.
20.3. These Terms, the applicable product or order information, and any expressly incorporated policies or individually agreed order terms form the contract between you and TickCare. If translations differ, we will aim to resolve the difference fairly; any legally required local-language rights remain unaffected.
